Based on our experience with condos and home owners Associations living, some consider it either paradise or hell. For some reason, people either hate it or love it. There seem to be no middle ground. Our investigations into some of the most common areas of disputes suggest that miscommunication is often the primary source. On the one hand, most board members do not know their governing documents and on the other hand, most members expect board members to know their governing documents. As a result, Some board members are unable to rationally explain points of disagreement to the members. Conversely, there are members who blame without first consulting for themselves the relevant provision(s) of their governing documents that may provide answers their question(s). A good mediator will spot these types of disputes and help both parties resolve their differences.
